Gig flyers torn down by Fresno City Code Enforcement

I was at Livingstone's yesterday afternoon and saw a guy methodically taking down gig flyers from the telephone poles at the Bank of America, Livingstones and the Starline. At first I thought it was a bank employee or some disgruntled wingnut but when I asked him what he was doing I noticed he had a City of Fresno jacket on that said Code Enforcement. He said he was there because it was against the law to hang up these flyers. I asked him what about the bulletin board at the Old Archers music and he said
he was going to have to give them another $200 ticket for not removing the flyers from their property. What about the kiosk on Olive/Wishon I asked?
He said that was ok because it was designated for such flyering.

I think someone had to call to get him out there to take down the portion of the flyers that he got to. He could not get all the flyers down because some are glued on, taped on, on private property, out of reach, etc. If he comes back every day for the next year there will be more flyers hung up.

A city who claims it wants to be local musician-friendly and yet takes down our gig flyers in the Tower district, right in front of the venue is highly conflicted.

Help out local businesses by not putting them in position for them to be fined by the city.

Think of it this way, when you were a kid in your parents home...you lived by their rules. if you broke the rules there was probably some kind of punishment. well, living within the city, county, state, and nation there are rules set by each level of government. they can place rules (laws) on even the most trivial of matters such as flyers on poles, buildings, boards, height of flag poles, restrictions on height of fences along property lines, parking on the lawn, etc. If people do not like it, they can work with the city to change it....or just move to another city...Berkeley would be right up your alley.

It actually is against the city code (law) to place flyers on city property. the code also has restrictions on postings on private property. The code is there to protect the city as well as the owners from people posting junk on their property. you don't want the city posting billboards on the front of your house for some news on road repair so why would the city want you to post your flyer for your band?

Call Code Enforcement and ask them what the code is, they will explain it to you. also check online, municode.com

Code Enforcement generally gets involved when someone calls and complains to them.

Might want to bring some tape to, to put up the flyers in the windows of business owners that are nice enough to let you do it.

And if they say no, we cover their car in said tape. That'll learn em.

Seriously this is fricken ridiculous. I can understand telephone poles and what not, but to deny them from storefronts? Why not focus on the blight that is Blackstone Ave? Those signs are much more of an eyesore then a few 8.5x11 flyers.

heard about this last week

They are ticketing 200.00 per day, and it's citywide.
-This is not just flyers posted up on poles and such
(but)
-apparently posters in windows as well.

I was able to look up the ordinances on-line (via this link: http://library2.municode.com/default/template.htm?view=document&doc_acti...) and it looks like you cannot post on any light pole, telephone pole, etc. Also you can't post on a building without the owners's consent. Here's the ordinances as they are written:

SEC. 12-1806. POSTING OF ADS ON POLES OR STREETS.
No person shall post, stick, stamp, print or otherwise affix or cause to be posted, stuck, stamped, printed or otherwise affixed, any bill, poster, advertisement, notice (except official notices) or candidate card upon any telegraph pole, telephone pole, fire alarm pole, electric light pole, electrolier, awning or shelter pole, or upon any public street or street furniture or any appurtenance to any of the aforesaid, or mar, deface, change the appearance of, injure or write upon any such pole, street, furniture or appurtenance, except as permitted by Section 13-108 of this Code; provided, however, owners or occupants of property may paint or employ persons to paint their address number on the curb in front of the property owned or occupied by them pursuant to Article 14, Chapter 9 of this Code. (Orig. Ord. 1930; Am. Ord. 6811, 1966).

SEC. 12-1807. POSTING OF ADS ON BUILDINGS, FENCES, ETC.
No person shall paint, mark or write on or post or otherwise affix or attach any bill, poster, notice, advertisement or candidate's card to or upon any building, wall, fence, or other structure or part thereof, or upon any private property without the written consent of the owner, agent or occupier thereof; provided, that nothing in this section shall prevent the posting of notices required by law. (Orig. Ord. 1076; Am. Ord. 6008, 1961).

But then there is this which almost contradictory (note I'm not a lawyer though I play one on TV).

SEC. 12-1809. MUTILATION OF HANDBILLS OR SIGNS.
No person shall tear down, mutilate, remove, deface or destroy any notice, handbill, or sign of any business or performance of any kind, or any ornamental sign or awning posts, or any news or bulletin board, or any street name sign or traffic sign. (Orig. Ord. 2980).

So I guess unless you are an employee of the CoF then you cannot take down fliers? I'm confused.

I helped post fliers for the Tower Ghost Walk back in Oct. (my group is the one who did the research for the tour) and we just asked each establishment if we could post a flyer and all said yes. I don't see why businesses would say no to this.

I'd be more then happy to pound the pavement on Friday night and see if I can get some flyers up.

And I hope this blog thread hasn't been hijacked. It still sucks that stuff was being taken down. I'm gonna see if I can do a little investigating and see what the actual law is. But this is the first I've heard of stuff being taken down and I've been going to Stone's/Starline for years.

I could see them tearing them down for a good reason: In a residential area or some other inappropriate place, flyers with objectionable content, etc. But, for gigs at The Starline, on the telephone pole right in front of the club just doesn't make sense. And they didn't even begin to get all of them, just a few right there on the telephone poles in front of BofA and the Starline.

Weird, my girlfriend has me also walk ten paces behind her.

I'd love to help out though, sounds like it would be a blast. That and I already selected my ninja outfit out....

I think if people did take down their fliers after the gig or yard sale was over this would not be a problem. It would be more informative as well.The city has laws about the amount of yard sales you can have in a year not because they don't like yard sales but because some people start to have a yard sale every weekend and make it their business. In the same way somebody puts up too many fliers, doesn't pull them down afterwards, uses glue, on private property the city makes laws. Obviously somebody complained to get the city out.

We should petition the City

The city should have Public Info Boards located throughout Tower, and elsewhere if needed, that you can put your flier up without hassle. That's the problem with Fresno, those in charge do not think out of the box!

I think that a petition is in order.

I am torn on this subject. I am all for posting fliers in proper places. I am against them posted on trees, lightpoles and such. It gets old when the poles and such have fliers from last months yard sale. It looks tacky and reflects poorly on the area they are located.
If the fliers are removed after the end of the sale or event, then fine. Knock yourself out putting them everywhere. The problems is the fact that people don't remove the old fliers.

I hang out there regularly and i havent noticed a change in the bulletin board on Audies building or the two sides of Mings which are used for hanging fliers.
i'll have to check now.
I'm super bummed because i was planning a sneak attack on all the walls in the tower for our upcoming bout!

Someone must have complained about it unless CoF has a special anti-flyer CTUesque division (sorry I'm having 24 withdrawls) and some guys sole job is to patrol the streets looking for flyers that deserve to be taken down with a ripped out jugular (sorry more 24 withdrawl pains).

I'm also curious about what it's like in other parts of the city. I live on Nees, and sometimes I see posters hanging on street posts over there for events that are a few weeks old.

I wonder if Stone's is the only place where this happens? I still can't believe they sent a city employee to take them down.

I scour the 'Net for fliers pretty much every day, but never find EVERYTHING, so anybody who has contributions, can always email links to mosegueda@fresnobee.com.

Also: Thanks Dale for posting this. If I get some time soon, I'm going to try to look into this a little more.
